To Schedule your 1:1 Appointment: All scheduling must be completed by you (the account owner) to ensure privacy and fairness with all clients. We do not book/cancel client appointments or schedule clients. We are unable to book and/or cancel your sessions from our end. Once the available times have been released to the public, please follow these steps to complete your booking:

4: ADD-ONS
Guests: If you want guests to attend your private session, we charge a $50 per person "Guest Fee". This will be charged to your account prior to your session and you must alert us that there will be guests at your session.
Travel Time: If you request us to show up at a physical location of your preference, we charge $300/hr for travel time and/or a flat fee of $1,000 for travel up to 2 hrs. Beyond 2 hours, we charge a $3,500/day Travel Fee.
Off Hours/Holiday: To satisfy your request for a time not available on our public website and/or service on Holiday, you can request this and submit to our rate of $300 per request.
Over/Time and Overage fee: If your session goes over the time amount paid for, you will be charged an Over/Time fee of $1,500/hr. This will be charged to the card on file.
Overage: With your Month Pro Plan, receive 200 minutes of viewing content. If you use more than 200 minutes in the month, you will be charged an Overage via Payment Plan. Under the Month Pro Plan, you can receive an additional 200 minutes in that month cycle for $100. With your Annual Elite Plan, receive 2000 minutes of viewing content. If you view over 2000 minutes, receive 500 additional minutes for $100 via Payment Plan. With excessive data usage, we must maintain the quality of our service, cloud storage, high-speed streaming quality, and software costs. Many cloud-based services have rates and limits and charge overage fees to sustain maintenance and quality. If your account is not up balance, you will have a 3 day Grace period to pay your bill. If your bill is not paid, we will freeze your account until the balance is settled. While your account is frozen, it allows for users that have a settled balance to maintain their viewing with settled payments.
5: PAYMENT
Payment Terms: Payments must be made in full to access the platform, receive services, and the license to view our content. Failure to make the full payment can result in a transfer, partial access to content, downgrade to basic, frozen account and/or disabled access. To gain access to your license to view our content, you must pay the full balance.
Maintain A Healthy and Active Account: To keep an Active Account, you must have a card on file, a signed updated Terms of Service and Waiver Agreement, and a settled balance paid. If any of these requirements are not met, your account will be disabled and/or frozen. We provide a 3 day Grace Period to give you time to settle the balance with money owed and to sign an updated member agreement to receive your license to view content and receive services. If you do not pay or have a signed agreement after 3 days, we will terminate and/or disable your account.
To restore your account, you agree to be charged an additional $100 restoration fee for account activation, maintenance, administrative, and software fees; including paying the unsettled balanced owed. If you complained to your bank, you are responsible to pay the full cost of the Charge-Back including all fees. We thank you for respect our work, team members, and partners delivering great service and quality support.
Membership Status: Based on your membership status and Health of your Account, you will receive access via a certain license to view your videos and credits to book class and appointment.
Requests and Changes to Services: Any changes to the Services, including the schedule, requests, location, program, brand, company policies are subject to fees. These fees are clearly listed as “Add-ons” under the “Appointments” page. Any change to schedule or moving of booking time or appointment is subject to Nicole’s Over/Time fee. If you request to move the time, the booked time counts as a booked session and you will receive No credits or Refund back. The fees are subject to increase based on market and on-going service demand.
The Real Value of The NW® Service: With two decades of real world professional work in the field of entertainment, dance, and health provide you with the time and effort it takes to deliver great results. With 10 years of dedicated research to music psychology and therapy research in IFS, AEDP, and EMDR we provide our high-profile clients’ with great mind-body results. With expert research in kinesiology, anatomy, and physiology research, Nicole prepares to support her clients during the Super Bowl, Live Performances, NBA and NFL many music videos, and our world’s best athletes and artists to maintain top condition and artistry during high energy out-put physical performances. Her background in 3 rigorous Broadway shows provides knowledge on how to cross train the body and protect it from overuse. Our results include mental, emotional, and spiritual well-being to live beautiful.
Our famous NW® 15 year process: We designed our private 1:1 services requiring mindful preparation, planning, and execution. Our real world expertise and knowledge is updated annually in courses in anatomy, physiology, and eastern medicine to enhance and modernize our service. We allocate around seven hours ahead of your first Session and around four hours for every session thereafter. We believe the positive energy that goes into each project is reflected in the results and each body deserves a carefully curated designed program to positively shape the body and mind.
How To Settle Remaining Balance: If you want to settle your balance, we can charge the card on file from our POS and/or send to you a payment link to pay your balance. Balance must be paid in full. If you prefer to handle the payment themselves, unfortunately, you do not have the ability to apply credits and pay the remaining balance online. This process must be carried out by us from the POS.
You will need to contact us to process the payment. We can offer to process the payment for you or we can offer to process the payment for them and ask if you would like to provide payment details over the phone and/or charge the card on file. We ensure all payment information is handled securely. Please write to nicoleatnicolewinhoffer.com to set up.
No Charge-Back Clause: By purchasing from NW Studio, Inc, and the Nicole Winhoffer®, NW®, NW Church®, NWMethod® products, you explicitly agree not to initiate any chargebacks against the company for any reason related to the purchased product or service. If you file a chargeback against the Merchant, your customer account may be terminated. To restore your account and acquire access to the platform, you agree to pay the fee of the entire disputed amount (includes the total amount of funds claimed by your bank) and an additional $100 fee to cover the fees of administration, unreturned software fees, late fees, and credit card fees.
We will not tolerate attacks or harassment of any kind made toward the Merchant or any members of our team. Charge-backs made with irrational motivations, impatience, confusion, or frustration will result in immediate termination of your account and no access to our Platform and/or any and all services, memberships, products, programs, and access to Nicole Winhoffer®, NW®, NW Church®, NWMethod®. We expect a collaborative talk with the Merchant to reach a resolution and should be approached with patience, care, and kindness.
Price Changes and/or Increase Policy for service providers and subscriptions: We follow a regular review process schedule to analyze results of our product and potentially adjust price based on value, demand, market dynamics, and internal costs such as increased labor costs, material expenses, software fees, administrative fees, regulatory compliance, and demand. We offer tiered pricing structure for various packages and client types. We notify customers at least 1 week to 30 day notice for our price increase.
Unsettled Balance Procedure: If you, "customer" do not agree to price and/or have an Unsettled Balance, your customer account can result in transfer, partial access to content, downgrade to basic, frozen account, and/or disabled access until the balance is paid in full. You may also be restricted from receiving our Weekly Guided Emails, Email Newsletters, Transactional Emails, and our forms of communication that are received when an account is active and healthy. By signing our contract, you agree to this term. To Restore and/or Re-gain access to your license to view our content, you must pay the full balance Restoration Fee; the fee of the entire disputed amount (includes the total amount of funds claimed by your bank) and an additional $100 restoration fee to cover the fees of administration, unreturned software fees, late fees, and credit card fees. We will not tolerate attacks or harassment of any kind made toward the Merchant or any members of our team.
If the Customer fails to make payment of any sum due to be paid to the Supplier under this Agreement by the due date for payment, then without prejudice to any other rights and remedies available to the Supplier: (a) the Supplier may, without liability to the Customer, disable the Customer’s access to and/ or use of the Service (or any part of it) and the Supplier shall be under no obligation to provide any or all of the Service while the outstanding amounts concerned remain unpaid.
We may change our subscription plans and the price of our service from time to time; however, any price changes or changes to your subscription plans will apply no earlier than 14-30 days following notice to you.
If a customer fails to pay any outstanding balance due on their subscription within 3 days, We NW Studio, Inc and Our Partners reserve the right to downgrade, suspend, or terminate access to the service until the balance is fully settled, including any associated fees or late charges, as per the terms outlined in this agreement.
6: ALL SALES ARE FINAL, NO REFUNDS.
All sales are final and non-refundable. We do not offer refunds or credits for any purchases, unused subscription periods, accidental purchases, medical conditions, or any similar reason or event, unless required by law to do so. By investing in yourself and purchasing NW® products, commitments are made by both parties to provide the tools and service needed to deliver the results of your transformation. It is understood that NW Studio, Inc can terminate clients at any time.
NW® and NWMethod® Private Training Cancellation: If you booked the service with an NW Method® Trainer and/or booked online, this counts as a booked session. Canceled sessions count as a used session and you will not receive a credit back for a used session. The Coach must be paid once the Coach is booked. No Show: If you do not cancel your appointment in advance, and do not show up at the time of the scheduled service, you will be charged the full cost of that service, and are not entitled to any credits back.
NWMethod® and NWChurch® Group Class: If the class or service is canceled within 48 hours of scheduled time, you will receive a "credit back" to your customer account. Less than 48 hour cancellation, will result in a used class. Classes hold limited slots and many classes and events sell out.
Cancellation Policy Subscription, Memberships, Classes: For all services, memberships, classes and products offered by Nicole Winhoffer®, NWMethod®, NW®, and NWChurch®. If the service is cancelled after your card has been billed for the month or year, there will be no refund. Your subscription will continue to be active until the end of your current billing cycle. Your subscription will not renew following the end of your current billing cycle. To cancel your Monthly Subscription, it must be done at least 48 hours before the renewed billing date. If it is done after the renewal date, you will be charged the full amount until the end of the billing cycle. To cancel your Annual Subscription, it must be done at least 30 days before the renewed billing date. If you cancel after the renewal date, you will be charged the full amount until the end of the billing cycle and are not entitled to a refund or any credits back. In dispute, you agree to have your card on file charged the full amount disputed by the bank and a $100 dispute fee to cover the fees of administration, unreturned software fees, late fees, and credit card fees.
Private 1:1 Training: The NW® Program is a holistic exercise program that uses consistency and repetition to build muscle memory. This requires scheduling your privates on the same day/time each week. By committing you are reserving a block of time for the teacher and yourself. If your reserved day and time need to change, it requires at least a two week notice and a commitment of two months to reserve a spot. We appreciate your care and respect of booking our services with our beautiful talented human beings.
NW® Single 1:1 Private Service has expiration date of 14 days from date of purchase. Unused sessions past purchase date, expire. NWMethod® 1:1 Digital Level Up 10 pack expires 45 days from date of purchase. Unused sessions past purchase date, expire. NW® Single 1:1 Private Service 10 pack expires 45 days from date of purchase. Unused sessions past purchase date, expire. No refunds. We appreciate your understanding and respect of private clients on the waitlist and know the rate and fees include costs for time, software, administration, and market demand. We do not schedule your sessions for you.
7. USER EXPECTATIONS
Relationship Treatment: We are providing great service for you and expect our teachers to be treated with respect and care. We will not tolerate greed, entitlement, or Abuses (see Section 9 Terms and Conditions). We serve customers who practice care, respect, and kindness. Thank you for respecting our policies that enable us to provide you great Service.
Communication: Texting/Emailing/Calling: We can respond within the business hours of Monday-Friday 9a-5p re inquiries. Patience is a part of your fitness and health journey. Our culture is dedicated to Patience Plus. We will not respond to requests outside our customer service hours or any communication containing abuses of any-kind (see Section 9 in Terms and Conditions). Sending a high volume of messages can disrupt the enjoyment of our customers and customer service representatives. Thank you for respecting our mental health and well-being boundaries.
Requirements: (1) Treat humans, teachers, and service providers with kindness and respect. (2) Incessant emailing, texting, calling, dm’ing is aggressive, unnecessary, unkind behavior. (3) We expect healthy dialogue and appropriate language free of violence and hate. We do not tolerate derogatory, negative, discriminatory hate speech of any kind. (4) We choose who to offer our energy and service. (5) We do not provide our service to entitled, derogatory, aggressive, disrespectful, clients that lack human dignity. (6) We do not book your appointments for you.
Be prepared: This means showing up early, professionally dressed, awake, phone away- ready to work hard. Be organized.
Discipline and No-Dunning-Kruger Effect: During your time with the NW® Teacher, you trust and respect our process and leadership. As a student, you practice discipline, attentiveness, patience and good listening skills to follow and learn from the NW® Teacher. Suggestions and changes to your program will be taken into consideration as feedback, but we will not tolerate “Dunning-Kruger effect”. That is claiming to know more, ie. a cognitive bias that causes people to overestimate their knowledge and abilities. Our approach and culture do a very specific Work. By signing up and agreeing to be an NW® Student, you trust and follow the process.

Phone/Watch: The use of electronic devices during sessions are not allowed. This time is to focus on centering and raising your vibration. Please put your phone and devices away at the start of the session.
Call out: If you are sick, please notify the Company at least 48 hours ahead of time. Your session will be paid for his/her scheduled time. If you are sick day of, this will count as a used session and our Teacher needs to be paid for his/her time and deprivation from welcoming other Wait-listers to book with him/her. We do not want to put our trainers in a situation where their health is at risk and we appreciate your understanding and acceptance of this Studio Policy to honor their commitment and time. You can notify the company by cancelling your session in the app and sending an email to nicole@nicolewinhoffer.com. No exceptions and we appreciate you respecting and acknowledging our culture and how we efficiently run our business.
Customer Behavior: With your positive attitude and trust, we continue to progress and deliver great exercise. If your behavior directly interferes with the Owner, our students, and any members of our team, you and your account will be terminated immediately. Based on the severity of customer behavior; e.g. the level of harassment, verbal abuse, or disruptive actions by the customer towards the employee; and/or forces a member of our team to leave their job, we will take the proper actions to have the behavior corrected and removed. Essentially, the actions you take, if a hostile work environment is created, we will terminate you immediately.
